RETURN, WITHDRAWAL AND REFUND POLICY

This Return, Withdrawal and Refund Policy applies to consumer orders placed through the Apex Weave website.

Apex Weave is operated by APEXWEAVE S.L.

1. RETURN AND WITHDRAWAL PERIOD

Customers located in the European Union or European Economic Area may exercise the statutory right of withdrawal available under applicable consumer law.

Where the statutory right of withdrawal applies, the customer must notify Apex Weave within 14 calendar days from the day on which the customer, or a person designated by the customer, receives the goods.

If several products from the same order are delivered separately, the withdrawal period begins on the day the final product is delivered.

After notifying Apex Weave of the withdrawal, the customer must return the goods without undue delay and no later than 14 calendar days from the date of the withdrawal notification.

For customers outside the European Union and European Economic Area, Apex Weave offers a voluntary 14-calendar-day return-request period for eligible standard products, unless mandatory local consumer law provides otherwise.

This voluntary return policy does not limit any mandatory consumer rights applicable in the customer’s country of habitual residence.


2. ORDER CANCELLATION

Customers may request cancellation within 24 hours after placing an order, provided that fitment confirmation, production, supplier processing, customisation or shipping preparation has not already begun.

A cancellation is only accepted once confirmed in writing by Apex Weave.

Because most Apex Weave products are made to order, cancellation may no longer be possible once production or supplier processing has started.

This operational cancellation period does not replace any statutory right of withdrawal that may apply after delivery.


3. MADE-TO-ORDER PRODUCTS

Most Apex Weave products are manufactured or prepared after the order and fitment details have been confirmed.

“Made to order” describes the production and fulfilment process. It does not automatically remove a statutory withdrawal right.

Standard catalogue products, including the motorcycle applications, weave options and finish options normally offered on the product page, will be handled in accordance with the mandatory consumer law applicable to the order.


4. PERSONALISED AND CUSTOMER-SPECIFIC PRODUCTS

Where permitted by applicable law, the right of withdrawal may not apply to products manufactured according to the customer’s individual specifications or products that are clearly personalised.

This may include:

- non-standard colours, fibres, materials or finishes;
- customer-requested dimensions;
- modified mounting points, holes or structural features;
- personalised names, graphics or logos;
- non-standard weave or finish combinations;
- products manufactured using customer-provided measurements, photographs, templates or original parts;
- other customer-specific modifications that make normal resale impracticable.

Where a product is excluded from withdrawal because it is personalised or customer-specific, this will be disclosed before the order is completed.

This exclusion does not affect the customer’s rights where the product is incorrect, defective, damaged or otherwise non-conforming.


5. PRODUCT CONDITION AND LOSS OF VALUE

Returned products must include all supplied parts, mounting hardware and accessories and must be securely packaged for return transport.

Customers may inspect a product only to the extent reasonably necessary to establish its nature, characteristics and functioning.

The customer is responsible for any diminished value caused by handling beyond what is reasonably necessary for inspection.

Carbon-fibre motorcycle parts must not be cut, drilled, sanded, ground, trimmed, painted, refinished, structurally modified or permanently bonded before fitment has been fully checked.

The following actions may make a carbon-fibre product unsuitable for resale as a new product:

- cutting, drilling, grinding, sanding or trimming;
- modifying mounting holes or attachment points;
- structural modification;
- painting, coating or refinishing;
- applying permanent adhesive, sealant or bonding products;
- installation damage;
- road or track use;
- scratches, cracks, impact damage or heat damage;
- missing parts, mounting hardware or accessories;
- damage caused by unsuitable return packaging.

Where such handling, use or modification means that the product can no longer reasonably be resold as new, the loss in value may amount to the full value of the product.

In such circumstances, the refundable amount may be reduced to zero where permitted by applicable law.

Apex Weave will assess the actual loss in value individually and may request photographs, video or physical inspection of the returned product.

This section does not limit the customer’s rights where the product was already incorrect, defective, damaged or non-conforming when supplied.


6. FITMENT RESPONSIBILITY

Customers must provide accurate information about the motorcycle manufacturer, model, production year, market version and original part shape.

Customers should carefully compare the product images, mounting points and compatibility information before installation.

If a fitment issue is identified, the customer must stop installation and contact Apex Weave before cutting, drilling, sanding, trimming or otherwise modifying the product.

If Apex Weave supplied the correct product according to the information provided by the customer and the compatibility information shown on the website, but the customer selected or provided incorrect motorcycle or fitment information, the return will normally be treated as a standard return.

In that situation, the customer is responsible for the direct return shipping costs and any applicable loss in value.

If Apex Weave confirmed an incorrect fitment, supplied the wrong product or provided materially inaccurate compatibility information, Apex Weave will bear the reasonable costs required to return, replace or otherwise resolve the issue.


7. INCORRECT, DAMAGED OR DEFECTIVE PRODUCTS

If a product arrives incorrect, damaged, defective or materially different from its description, the customer should contact Apex Weave as soon as reasonably possible at:

The customer should provide:

- the order number;
- the name and email address used for the order;
- photographs of the product;
- photographs of the external and internal packaging;
- a photograph of the shipping label;
- photographs or video clearly showing the issue;
- the motorcycle manufacturer, model, year and market version where fitment is involved.

Customers should retain the original product packaging until the claim has been reviewed.

Apex Weave will review the information and provide the repair, replacement, price reduction or refund remedy required under applicable law.

Where Apex Weave supplied an incorrect, defective, damaged or non-conforming product, Apex Weave will bear or reimburse reasonable return or replacement costs where required by applicable law.


8. RETURN INSTRUCTIONS AND RETURN ADDRESS

Customers must contact Apex Weave before returning any product.

Apex Weave will provide the correct return instructions and designated return address after reviewing the request.

European returns are normally handled through a designated return location in Spain.

For customers outside Europe, the return address may vary depending on the destination, product, logistics route and nature of the case.

The designated return address may differ from:

- the company’s registered office;
- the original shipping origin;
- the supplier or manufacturer address.

The company’s registered office is not a general product-return address.

Customers must not return products directly to a supplier, manufacturer, registered office or any other address unless instructed in writing by Apex Weave.

Returns sent without the correct instructions may be delayed and may result in additional carrier, customs, storage or handling charges. These charges may be the customer’s responsibility where permitted by law.

Requesting return instructions does not remove or reduce any statutory right of withdrawal.


9. RETURN SHIPPING COSTS

For standard withdrawals or voluntary returns, the customer is responsible for arranging and paying the direct cost of returning the product.

Carbon-fibre motorcycle parts may require tracked, insured or oversized return shipping. Return costs depend on the country, parcel dimensions, weight and carrier.

Customers should:

- use suitable protective packaging;
- use a tracked shipping method;
- obtain appropriate transport insurance;
- retain proof of shipment and tracking information.

Apex Weave is responsible for reasonable return or replacement shipping costs where the return results from:

- an incorrect product supplied by Apex Weave;
- incorrect fitment confirmed by Apex Weave;
- a defective or non-conforming product;
- transport damage for which Apex Weave or its delivery partner is responsible.


10. REFUNDS

Once a returned product has been received and inspected, Apex Weave will notify the customer of the refund decision and any lawful deduction for diminished value.

Refunds will normally be issued to the original payment method.

Where a statutory right of withdrawal applies, reimbursement will be made without undue delay and within the period required by applicable law.

Where permitted by applicable law, Apex Weave may withhold reimbursement until:

- the returned goods have been received; or
- the customer provides satisfactory evidence that the goods have been returned,

whichever occurs first.

Where required by law, Apex Weave will refund the price paid for the returned product and the cost of the least expensive standard outbound delivery method offered for the order.

Any additional amount paid for express, premium, priority or upgraded delivery will not be refunded beyond the cost of the least expensive standard delivery method.

For partial-order returns, the original outbound delivery charge may not be refundable unless required by applicable law.

Any lawful deduction for diminished value will be based on the actual condition and remaining resale value of the returned product.


11. REFUSED, UNCLAIMED OR FAILED DELIVERIES

Refusing a parcel or failing to collect it does not automatically constitute a valid withdrawal request.

The customer should contact Apex Weave in writing to exercise an applicable withdrawal or return right.

If a parcel is refused, unclaimed or cannot be delivered because the customer provided an incomplete or incorrect address, reasonable return, redelivery, storage, customs, carrier or handling costs may be deducted from the refund where permitted by applicable law.

This does not apply where the delivery failure was caused by Apex Weave or by a delivery partner acting on behalf of Apex Weave.


12. RETURNS THAT MAY BE REFUSED OR REDUCED

Subject to mandatory consumer law, Apex Weave may reject an ineligible voluntary return or reduce the refundable amount where:

- the applicable return or withdrawal period has expired;
- the product was clearly personalised or manufactured to individual customer specifications and the exclusion was disclosed before purchase;
- the returned item is not the product originally supplied;
- the product has been cut, drilled, sanded, trimmed or structurally modified;
- the product has been painted, refinished or permanently bonded;
- the product has been installed, used or damaged beyond what was necessary for inspection;
- mounting hardware, accessories or other supplied parts are missing;
- the product was damaged due to inadequate return packaging;
- the customer has not returned the product or provided valid proof of return.

Where modification or damage has destroyed the product’s normal resale value, the reduction may equal the full value of the product and the refund may therefore be reduced to zero where permitted by applicable law.

Nothing in this section limits mandatory rights relating to incorrect, defective, damaged or non-conforming goods.


13. STATUTORY CONFORMITY RIGHTS

Nothing in this policy excludes or limits any mandatory consumer right, statutory conformity guarantee or legal remedy that cannot lawfully be excluded.

For consumer sales governed by Spanish law, new goods are covered by the statutory conformity rights applicable under Spanish consumer law.

Any separate commercial warranty offered by Apex Weave is additional to, and does not replace, the customer’s statutory rights.


14. HOW TO REQUEST A CANCELLATION, RETURN OR REFUND

To request a cancellation, withdrawal, return, replacement or refund, contact:

Please include:

- order number;
- customer name;
- email address used for the order;
- product name;
- motorcycle manufacturer, model, production year and market version;
- reason for the request where relevant;
- photographs or video where the request concerns damage, defects, incorrect fitment or an incorrect product.

Apex Weave will review the request and provide written instructions for the next steps.


15. APPLICABLE LAW

This policy is governed by Spanish law.

Customers retain any mandatory consumer rights granted by the law of their country of habitual residence that cannot legally be excluded or limited by contract.
